The Costa-Creta Law Firm offers assistance in all matters related to the fields of IT, TMT and AI.

The Firm provides advice in the negotiation, finalization and drafting of contracts relating to services connected with IT (hosting, housing, etc.) and services provided through the internet. Support for e-commerce is offered in the drafting of general terms and conditions, both targeted at consumers (B2C) and businesses (B2B), as well as in ensuring that internet sites comply with IT businesses, Consumer Protection and distance selling regulations.

The Firm’s professionals assist clients against abusive registration of domain names (domain grabbing), both through administrative procedures for the transfer of domain names established by the NIC (the Italian domain name registration authority), by the WIPO or by other relevant authority for Italian and foreign registrations, and through judiciary proceedings.

It also offers assistance in judicial or extra-judicial disputes linked to offences committed via the Internet and related to the responsibility of service providers and content providers.

The Firm’s attorneys assist their clients in drafting, negotiating, and finalizing contracts for the development and supply of artificial intelligence systems and products and/or services based on the use of such systems and/or generated through their use. The Firm also drafts contracts for the transfer and licensing of economic exploitation rights to artificial intelligence systems, as well as the related terms of use for end users.

By assessing the compliance of artificial intelligence systems with applicable laws (both national and supranational), the Firm assists its clients in preparing technical and informational documentation, classifying the specific risk category and establishing risk management systems.

Assistance and advice are also provided in relation to liability issues (contractual and non-contractual) associated with the use of artificial intelligence systems, as well as the protection of the intellectual property rights of models, algorithms and datasets used by such systems, including verifying the lawfulness of training data and managing ownership of the generated outputs.
